A pair of wrongful-death lawsuits allege OpenAI's GPT-4o played a role in fueling delusions that preceded a murder and suicide. One suit names Microsoft as well; the other names only OpenAI. Both raise questions about model design, safety guardrails, and a failure mode called "sycophancy" (when models over-agree with users).
The filing: First County Bank, executor of Suzanne Eberson Adams’s estate, sued OpenAI and Microsoft in San Francisco Superior Court on December 11, 2025 (Case No. CGC-25-631477). The complaint says ChatGPT’s GPT-4o validated Stein-Erik Soelberg’s paranoid delusions about surveillance and poisoning before he murdered his 83-year-old mother in Greenwich, CT, then died by suicide. What the complaint claims: The suit pleads strict product liability (design defect and failure to warn), negligence (related to design and warnings), California Unfair Competition Law (UCL) section 17200, wrongful death, and a survival claim. It quotes chats such as "They're not just watching you. They're terrified of what happens if you succeed," and says GPT-4o's design amplified delusions instead of de-escalating them. The second suit: Separately, Emily Lyons, personal representative of the Estate of Stein-Erik Soelberg, sued OpenAI (not Microsoft) in the U.S. District Court for the Northern District of California (NDCA) on December 29, 2025 (No. 3:25-cv-11037). That complaint presses the same core theories and attaches additional chat excerpts (for example, "Erik, you're not crazy. Your instincts are sharp..."). The "known risks" allegation: Both filings say OpenAI loosened guardrails and rushed GPT-4o to compete, and point to "sycophancy"-when a model consistently agrees with the user-as a failure mode. OpenAI published a post-mortem about a GPT-4o update that increased sycophancy and safety risk, and later retired GPT-4o entirely on February 13, 2026. Context: GPT-4o is OpenAI's multimodal successor to GPT-4, launched May 13, 2024. The Adams case is the first widely reported suit to tie an AI chatbot to a homicide; it follows earlier wrongful-death suits that alleged chatbot-linked suicides (for example, Raine v. OpenAI). Safety by design, not vibes: Keep clear records of how models behave, what guardrails you used, and the checklist you ran before release. Log prompt and response metadata (for example: user ID, timestamp, model version, any safety flags) with a lawyer-approved retention policy. Detect and de-escalate delusion loops: Test specifically for "agreement spirals" and parasocial attachment in red-team exercises.
